Book excerpt: This report deals with the implementation in France of the duty to take compensation measures following Article 6(4) of the Habitats Directive. First of all, a general description is presented of the relevant French legal regime (Section 1). Next, this report focuses on the distinction that French law makes between mitigation and compensation measures (Section 2). In spite of this distinction, the case law about compensation measures following Article 6(4) of the Habitats Directive is rather ambiguous (Section 3). Finally, the question of financial compensation for those suffering disadvantage from the protection of Natura 2000 sites is dealt with (Section 4). Section 5 contains concluding remarks with a view to the future.
